The Johnson County Sheriff’s Office says a West Liberty man used his brother’s identity after his arrest on a drunk driving charge last year, leading to his brother’s arrest on a warrant a few months later.

29-year-old Victor Martinez of East 1st Street was booked into the Johnson County Jail just after 3:30 Friday afternoon. Arrest records indicate Martinez was arrested for Operating While Intoxicated on April 13th, 2018, and used his brother’s name when he was booked into the Johnson County Jail.

Martinez and his brother were arrested in Scott County on June 29th of this year, and it was discovered Martinez’s brother had a warrant for his arrest related to his brother’s earlier Johnson County OWI arrest.

Investigators used booking photos to determine that Martinez was not his brother.

Martinez is charged with Malicious Prosecution, A Serious Misdemeanor punishable by a maximum of one year in jail.
