A North Liberty man who allegedly called sobriety testing administered by Iowa City police “monkey games” has been charged with his second OWI.

According to the arrest report, 32-year-old Maxwell Albrecht of Cedar Springs Court was stopped near the intersections of Bowery and Dodge streets for allegedly failing to obey a traffic control device. Upon contact, Albrecht allegedly had bloodshot watery eyes, smelled strongly of consumed alcohol, and had thick slurred speech.

Albrecht reportedly told officers he had been out playing pool and was headed to a friend’s residence to play more pool.

He exhibited intoxicated tendencies and was transported to the PD for additional testing. After explaining the one-leg stand portion of the test, Albrecht stated he wasn’t going to participate in their “monkey games” and refused all additional testing. He reportedly stated he was okay to drive and if he was to submit to a PBT, he would pass.

Albrecht consented to a Datamaster test and showed his blood-alcohol level at .218, well over twice the legal limit. He was taken into custody and charged with his second OWI, an aggravated misdemeanor punishable by a maximum sentence of two years if convicted.
