An Iowa City man who attempted to use diplomatic immunity to avoid arrest and tried urinating in the kitchen at the downtown Iowa City Chipotle has been arrested again.

37-year-old Joseph Pospishil of Dover Street was arrested just after 4pm Friday near Pagliai’s Pizza for allegedly stealing an alcoholic beverage worth just over $3 from the cooler at the North Dubuque Street Casey’s. He has a trespass warning for the convenience store from previous thefts, and was seen trespassing there the day before.

Pospishil was also wanted for a theft the previous day at the West Burlington Street Kum & Go. Police say he entered the store just after 7:45pm, wrapped a $3 can of beer in his shirt and fled on foot. Pospishil was issued a trespass warning for all Kum & Go stores last August.

Pospishil is charged with 3rd Degree Theft, 5th Degree Theft, Trespassing and 3rd Offense Trespassing. If convicted, he faces a maximum of over two years in prison.

Pospishil made news last April after he attempted to urinate in the kitchen at Chipotle in the Old Capitol Town Center. Chipotle staff were able to chase him off before he could begin the urination process. Pospishil then walked through the mall, exited near CVS and urinated on a public mailbox near Clinton Street. He was arrested and charged with Public Intoxication.

Pospishil attempted to declare diplomatic immunity after another April arrest. According to police, Pospishil entered the Waterfront Hy-Vee and took items into the Market area. Store personnel observed Pospishil open a bottle of whiskey and start to drink it without paying for it. When confronted by management, he said the whiskey was paid for, and that he had diplomatic immunity.

Pospishil, who has an extensive shoplifting history, had previously been trespassed from the store in January.
