ICPD: UI student refused PBT without mother’s permission, demanded jury trial for Public Intoxication charge

A University of Iowa student kicked out of a downtown Iowa City nightclub allegedly refused to take a breath test without his mother’s permission, then demanded a jury trial once charged with Public Intoxication.

That’s according to Iowa City Police, who were called to The Fieldhouse on The Ped Mall just before 12:45 Sunday morning for a male in a Cubs jersey starting fights outside the bar. Arriving officers discovered that 19-year-old Nicholas Cappitelli of Villa Park, Illinois had been kicked out of the bar for starting fights. Cappitelli then allegedly tried to re-enter to fight Fieldhouse staff.

Police say Cappitelli began throwing the contents of his wallet on the ground when they asked for his identification. He also allegedly refused a portable Breathalyzer test, saying he would only do so if his mother told him to. Cappitelli’s mother was not present.

Police say Cappitelli showed signs of intoxication, smelled of ingested alcohol and made poor decisions. He’s been charged with Public Intoxication.

Online records show during a court appearance on Tuesday, Cappitelli demanded a jury trial. A case management conference is set for April 5th.
