You can be charged with an OWI without even being behind the wheel. Just ask a Solon man who was charged for that Sunday night.

According to authorities, 53-year-old Michael Mosley of Whispering Willow Lane was the passenger in a vehicle that he and the driver were having a domestic dispute in shortly after 7:30pm. Mosley allegedly grabbed the wheel during the altercation, which made the driver immediately have to pull the vehicle over.

Authorities noted a strong odor of alcohol, slurred or mumbled speech, bloodshot watery eyes and unsteady gait. Mosley allegedly admitted to drinking but refused a PBT or Datamaster test.

Mosely is charged with OWI second offense, having been convicted once before in 2011. He faces a maximum sentence of two years in prison if convicted.
