Transient who declared “diplomatic immunity” and tried urinating in Chipotle kitchen arrested again

An Iowa City man who attempted to use diplomatic immunity to avoid arrest and tried urinating in the kitchen at the downtown Iowa City Chipotle has been arrested again.

Iowa City Police on bike patrol encountered 36-year-old Joseph Pospishil of Dover Street with an open container of alcohol outside the East Burlington Street Kum & Go just after 7:30 Sunday night. Investigators say Pospishil was intoxicated and drinking from a Kum & Go cup containing soda and rum. He was also standing beside an open 175 ml bottle of Captain Morgan. Pospishil was given a verbal warning and told to leave the area.

Officers were called back to the Kum & Go minutes later after Pospishil allegedly went inside and stole a 40 ounce bottle of Olde English malt liquor. He started yelling at officers and using profanity in the parking lot.

Pospishil, who has history of stealing 40 ounce bottles of Olde English from Iowa City convenience stores, was arrested and charged with 5th Degree Theft, Public Intoxication and Disorderly Conduct. If convicted on all three charges, he faces a maximum of 90 days in jail.

Pospishil made news last April after he attempted to urinate in the kitchen at Chipotle in the Old Capitol Town Center. Chipotle staff were able to chase him off before he could begin the urination process. Pospishil then walked through the mall, exited near CVS and urinated on a public mailbox near Clinton Street. He was arrested and charged with Public Intoxication.

Pospishil attempted to declare diplomatic immunity after another April arrest. According to police, Pospishil entered the Waterfront Hy-Vee and took items into the Market area. Store personnel observed Pospishil open a bottle of whiskey and start to drink it without paying for it. When confronted by management, he said the whiskey was paid for, and that he had diplomatic immunity.

Pospishil had previously been trespassed from the store in January.
