Man accused of assaulting another moviegoer for talking on his phone sentenced to 2 days in jail

An Iowa City man who was accused of assaulting another moviegoer for talking on his phone has been sentenced.

The incident occurred on September 11th at the Marcus Sycamore Theatre. 34-year-old Nicholas Glasgow of G-Street was attending a late-night showing of the movie “Once Upon A Time In Hollywood” and complained to theatre staff about a man’s cellphone use before the movie began. He allegedly said if staff wouldn’t take care of it, he would.

When the movie ended around 1:15am, Glasgow is accused of approaching the man and his friend, demanding that they apologize for ruining the movie for him. Before the man could react, Glasgow allegedly started striking him in the face while he was still seated.

The two then began fighting, with the victim ending up on the ground and Glasgow kicking him. The man suffered a cut to his face, swelling, soreness and redness to his face, and his glasses were broken in the assault, according to the arrest report.

The description provided by the victim matched Glasgow’s driver’s license picture, which he had just updated earlier that day on his birthday.

A warrant was issued for Glasgow’s arrest in January, and he was charged with 5th degree criminal mischief and assault causing bodily injury.

On Thursday, a non-jury trial found him guilty of the criminal mischief charge and fined him $65. The assault charge was reduced to disorderly conduct-fighting or violent behavior and Judge Mark Thompson sentenced him to two days in jail, and suspended the fine.
