Omaha men arrested on OWI and weapon charges

Two Omaha Nebraska man were arrested early Friday morning after one allegedly left the scene of an accident and charged with OWI, while the other was reportedly determined to be carrying a loaded weapon while intoxicated.

32-year-old Dillon Mendoza was operating a white Chevy Silverado and was allegedly involved in a minor traffic accident in Iowa City near the intersection of Linn and College streets at approximately 1:10am. Police located him about ten minutes later in the parking lot of Tailgaters on First Avenue in Coralville.

Mendoza allegedly had the odor of ingested alcohol, slurred speech and bloodshot eyes.  After indicating impairment on field testing, he had a breath—alcohol level over the legal limit to drive on a PBT. A Datamaster reportedly showed it at .158 percent.

Mendoza’s acquaintance, 22-year-old Devin Stastny, also reportedly presented a noticeable odor of ingested alcohol, bloodshot watery eyes and slurred speech. Stastny allegedly made statements acknowledging that he had been drinking earlier and was too intoxicated to safely operate Mendoza’s vehicle.

According to the arrest report, Stastny was wearing a black cross-body bag with a clearly visible firearm.  A search incident to arrest reportedly discovered a FN Reflex 9mm firearm with a loaded magazine, additional magazines containing ammunition, and 4 individually rolled marijuana blunts.

Mendoza was charged with OWI first offense and faces up to a year in jail if convicted. Stastny was charged with Possession of Dangerous Weapons while Intoxicated, Person Ineligible to carry Dangerous Weapons, and Marijuana Possession. If convicted on all counts, he could be sentenced to up to three years in prison.
