Hearing involving Winneshiek County Sheriff and State AG moved to new date

A suit filed by the state’s Attorney General’s Office against the Winneshiek County Sheriff over a social media post has had its next hearing postponed.

CBS2 reports the continuance was granted by a judge to allow the parties to continue further discussions to resolve the case.

Sheriff Dan Marx posted in February on Facebook, stating that his department would not help ICE or the FBI with immigration detainers if he believed the requests were unconstitutional. He said his office’s oath and allegiance lies with the constitution and the protection of individual rights, and that they will cooperate with the Feds if their orders fall within those parameters.

Attorney General Brenna Bird took exception with Marx’s post, and demanded the post be taken down and replaced with an apology scripted by her office. Marx refused to issue the apology, leading to the suit being filed in March.

The hearing has been moved from July 18th to September 12th.
