Iowa Attorney General Brenna Bird has announced that she will dismiss her lawsuit against Winneshiek County Sheriff Dan Marx, saying Marx has now fully complied with Iowa’s sanctuary county law.
Marx posted on Facebook in February that his department would not help ICE or the FBI with immigration detainers if he believed the requests were unconstitutional. He said his office’s oath and allegiance lies with the constitution and the protection of individual rights, and that they will cooperate with the Feds if their orders fall within those parameters.
Shortly after the statement was posted, Governor Kim Reynolds filed an official complaint with Bird’s office. Bird then demanded the post be taken down and replaced with an apology scripted by her office. Marx refused to issue the apology, leading to a lawsuit being filed in March.
In Friday’s statement announcing the dismissal of the lawsuit, Bird says the Winneshiek County Sheriff’s Office is now in full compliance with the sanctuary county law.
