Victor man arrested for second OWI after allegedly found asleep in ditch

Being found asleep in his vehicle while it was parked in a ditch led to the arrest of a Victor man for his second OWI.

Police came upon a vehicle in the 1900 block of Copi Road Northwest in Oxford at around 5:30am Sunday sitting in the ditch with its lights on. 40-year-old Joshua Tandy of Harrison Street in Victor was reportedly inside the vehicle asleep in the backseat. Police allege he had bloodshot watery eyes, had the odor of ingested alcohol, and noted that his zipper was down.

Tandy reportedly said that he went off the road into the ditch and couldn’t get himself out.

He failed field sobriety tests and provided at PBT of .128, refusing Datamaster testing.

Tandy was charged with 2nd offense OWI, an aggravated misdemeanor punishable by a prison sentence of up to two years if convicted.
