Cedar Rapids woman reportedly uncooperative during OWI arrest

A Cedar Rapids woman was arrested on OWI and additional charges over the weekend.

34-year-old Artiniece Smith-Berry of 16th Street SE was northbound on I380 at the 1.7 mile marker just after 2:30am Sunday when she was stopped for an undisclosed traffic violation.  An odor of ingested alcohol was allegedly observed at the window of the vehicle along with the smell of marijuana.

Smith-Berry reportedly admitted to drinking and showed signs of impairment during field testing.  A PBT showed her breath-alcohol level at .132 percent.

She was arrested for OWI first offense and was placed into the patrol car to be taken to the University of Iowa Department of Public Safety for further OWI testing.  Smith-Berry then unbuckled herself and refused to let the officer buckle her.  She also reportedly wouldn’t let him have a conversation without interrupting him or the deputy.  She allegedly interfered with attempts to buckle her.  Smith-Berry then reportedly refused to get out of the patrol car to get into the deputy’s car.

A search of her vehicle reportedly turned up a bag containing an unknown amount of raw marijuana and an open bottle of liquor.

While at the UI Department of Public Safety offices, Smith-Berry refused to give a breath sample and refused to sign the computer screen. She allegedly argued about the Datamaster testing and what she was charged with.

Smith-Berry was charged with OWI first offense, marijuana possession, interference with official acts and an open bottle violation.  If convicted on all counts, she faces a  maximum prison sentence of 25 months.
